Oh dear.  That's one of the ones that should have been on the ESA list, I'm afraid - it's a direct Infogrames publication, and Infogrames (aka Atari) is still a prominent ESA member.

Whether ESA protection really means anything anymore now that it's been several years since their lawyers went on their C&D rampage is another matter.
